1. Overview

This Trust Center article outlines best practices and processes for managing Data Privacy Agreements (DPAs), also known as Data Sharing Agreements, between U.S. school districts and Kahoot!. DPAs specify how Kahoot! handles, stores, and protects student information for our school district customers. These agreements help ensure Kahoot! upholds the privacy and confidentiality of student data required by state student data privacy laws. As a “data processor,” Kahoot! processes student data solely for educational purposes as directed by the school district.

Depending on your district’s needs, there are several options for managing DPAs with Kahoot!:

  1. Use Kahoot!’s online Terms and Conditions and Privacy Policy which include key provisions commonly found in a DPA.
  2. Join Exhibit E through the Student Data Privacy Consortium (SDPC).
  3. Submit your district’s DPA template for Kahoot!’s review by emailing dpa@kahoot.com.

2. Kahoot!’s Term and Conditions

During the initial onboarding process, districts typically sign up for Kahoot! through an automated flow. As part of this process, districts agree to Kahoot!’s Privacy Notice, Terms and Conditions, and Data Processing Agreement
These terms are designed to be fair, transparent, and compliant with applicable data protection laws, ensuring that districts maintain control over their data. We believe that these terms, by themselves, may meet many DPA requirements so please feel free to review and confirm.

3. Join Exhibit E through the Student Data Privacy Consortium (SDPC)

The Student Data Privacy Consortium streamlines the contracting process between districts and edtech vendors. The consortium has created a SDPC Resource Registry that uses a template National Data Privacy Agreement (NDPA) for districts and applications to use. The NDPA includes an Exhibit E “General Offer of Privacy Terms” for other districts in the state to sign onto that same DPA.

To check if your state has a signed NDPA that your district can join, follow these steps:

Steps to Search the SDPC Database

  1. Visit the SDPC Resource Registry.
  2. On the homepage, locate the State Alliances section and click it.
  3. Select your state from the list, then click Visit Alliance.
    • (The state’s name will appear on the left side of the page.)
  4. In the middle of the page, find the Search the Database box and click Start Exploring.

This will display DPAs Kahoot! has signed with districts in your state. Most agreements are linked directly, allowing you to download them. If your state has a signed NDPA, you can simply download the agreement and sign onto Exhibit E.

If you are a Local Education Agency or School District, you may rely on a preexisting state DPA with Kahoot! instead of entering into your own. Kahoot! currently has a preexisting DPA with the following US states:
